What Happens When a Lawsuit Is Filed in Georgia?

Filing a lawsuit might sound like the finish line, but it’s really just the beginning. Once a complaint is filed in Georgia, the case follows a structured path through the court system. Knowing what to expect can help ease stress and set realistic expectations.

Step 1: The Complaint and Service

The process begins when your lawyer files a complaint with the court. This document explains what happened, who’s responsible, and what damages you’re seeking. Once filed, it must be served on the defendant — formally delivered so they know a case has been brought against them.

Step 2: The Answer

The defendant has 30 days to file an answer. In it, they may deny the claims, raise defenses, or even file counterclaims. At this point, the issues in dispute are officially framed.

Step 3: Discovery

This is usually the longest phase. Both sides exchange information through:
